PDX TRICKING LIABILITY WAIVER, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY

This Liability Waiver, Assumption of Risk, and Release of Liability ("Agreement") is entered into by the undersigned participant ("Participant") in consideration for being permitted to participate in martial arts training, classes, open mat sessions, competitions, fitness activities, seminars, and all related activities (collectively, the "Activities") offered by PDX Tricking, its owners, instructors, employees, coaches, volunteers, contractors, affiliates, successors, and assigns (collectively, the "Released Parties").

1. Acknowledgment of Risks

I understand and acknowledge that participation in martial arts and related physical activities involves inherent risks, including but not limited to:

• Falls, slips, trips, and collisions.

• Strikes, kicks, punches, throws, takedowns, joint locks, chokes, grappling, and submissions.

• Muscle strains, sprains, fractures, dislocations, concussions, and other serious injuries.

• Permanent disability, paralysis, or death.

• Exposure to communicable illnesses and infections, including skin infections.

• Risks arising from the actions or negligence of other participants.

I understand that these risks cannot be completely eliminated, even with proper instruction, supervision, and safety equipment.

2. Voluntary Participation

I voluntarily choose to participate in the Activities with full knowledge of the risks involved. I certify that I am physically capable of participating and have consulted a physician if I have any concerns regarding my health or fitness.

I agree to immediately inform an instructor if I become injured, ill, or believe I should discontinue participation.

3. Assumption of Risk

I knowingly and voluntarily assume all risks associated with participation in the Activities, whether known or unknown, foreseeable or unforeseeable, including those resulting from the ordinary negligence of the Released Parties to the fullest extent permitted by applicable law.

4. Release and Waiver of Liability

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising from or related to my participation in the Activities, including claims resulting from the ordinary negligence of the Released Parties.

This release does not apply to conduct that cannot legally be waived under applicable law, including gross negligence, reckless misconduct, or intentional wrongdoing where prohibited by law.

5. Medical Authorization

If I become injured or require medical attention while participating in the Activities, I authorize the Released Parties to obtain emergency medical treatment on my behalf if I am unable to do so.

I understand that I am solely responsible for all medical expenses incurred as a result of my participation.

6. Personal Property

I understand that the Released Parties are not responsible for the loss, theft, or damage of my personal property while on the premises or participating in Activities.

7. Rules and Safety

I agree to:

• Follow all gym rules and instructor directions.

• Use equipment only as instructed.

• Wear appropriate safety gear when required.

• Practice good hygiene and refrain from training while suffering from a contagious illness.

• Immediately report unsafe conditions or injuries.

I understand that failure to follow gym rules may result in suspension or termination of my membership without refund, subject to applicable law and any membership agreement.

9. Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from any claims, damages, or liabilities arising from my own actions, omissions, or violations of gym rules while participating in the Activities.

10. Governing Law

This Agreement shall be governed by the laws of the States of Oregon and Washington, without regard to its conflict of laws principles.

11. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the subject matter herein and supersedes all prior oral or written agreements relating to this subject.

13. Acknowledgment

I have carefully read this Agreement. I understand its contents and understand that by signing it I am giving up certain legal rights, including the right to sue, to the fullest extent permitted by law. I sign this Agreement voluntarily and without coercion.
